Title: Proposed Amendments to the FDIC's Section 19 Regulations 
Abstract:

Section 19 of the FDI Act (12 U.S.C. 1829), among other provisions, requires persons with certain covered criminal offenses on their records to obtain prior written consent from the FDIC before participating in the conduct of the affairs of any insured depository institution. On December 23, 2022, the President signed into law the Fair Hiring in Banking Act (Act), which was a part of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023. The Act significantly revised section 19 and was effective immediately. Accordingly, the FDIC is requesting comments on proposed amendments to its section 19 regulations under 12 CFR part 303, subpart L, due to the Act, particularly regarding areas in which the FDIC is interpreting the text of the Act.

The Act requires the FDIC, "In carrying out [the revisions to Section 19, to] consult and coordinate with the National Credit Union Administration as needed to promote consistent implementation where appropriate." Accordingly, the FDIC will consult and coordinate with NCUA staff--as well as staff from the FRB and OCC--regarding the implementation of the Act, including through rulemaking(s).
