Title: Ocean Common Carrier and Marine Terminal Operator Agreements

The Federal Maritime Commission (FMC) proposes to modernize outdated requirements and clarify existing requirements associated with the filing of ocean common carrier and marine terminal operator agreements subject to the Shipping Act of 1984. The rule would update certain definitions and the application of exemptions and monitoring requirements to more accurately reflect the modern ocean shipping industry; update the exemptions for certain classes of agreements and amendments to reduce industry burden; revise the Commission’s rules for the filing of agreements and required information in those filings to reflect advancements in technology; update the regulations regarding requests for additional information; clarify the application of information forms and monitoring requirements; and make miscellaneous revisions that streamline and clarify the application of these regulations and adopt best practices for regulatory drafting.
