Abstract: As the result of the U.S. District Court for the District of Montana vacating our February 27, 2008, final rule (73 FR 10514) on October 14, 2008, we are reopening the comment period on our February 8, 2007, proposed rule (72 FR 6106). We will issue a new listing determination.
