Terms of Clearance:
The FCC shall ensure that the cost of the diskettes is the marginal cost of their preparation and distribution. The instructions should also include the address of the website where the survey will be located. This information should also be disseminated via an FCC notice. The FCC also needs to promulgate the date when the surveys are due. The 1998 survey does not allow electronic filing -- future surveys should include this future. Also -- the FCC should revisit how the need to respond to the requirements of Section 623(k) of the CTCPCA can be met without conducting this burdensome survey. The FCC shall ensure that the OMB control number appears on the survey along with the date of issue. Finally -- OMB will no longer approve future surveys that do not publish at least one request for public comments in the Federal Register before submission to OMB.

Abstract:
Section 623(k) of the Cable Television Consumer Protection and Compeition Act of 1992 ("1992 Cable Act") requires the Commission to publish an annual statistical report on average rates for basic cable service, cable programming service, and equipment. The report must compare the prices charged by cable systems subject to effective competition and those not subject to effective compeition. The 1998 Price Survey is intended to collect data needed to prepare this report.
