Terms of Clearance:
This ICR is approved for one collection over a 2.5 year period. EPA is commended for its efforts to address the previous terms of clearance. One reform to the collection is the use of a Site Identification Form, which combines similar information from three separate collections: the Biennial Report, the Notification of Hazardous Waste Activity, and the Hazardous Waste Part A Permit Application. This new form has been assigned a separate OMB approval number. When this ICR is submitted for renewal, EPA must evaluate, after consulting with respondents, the burden estimates for reporting requirements. The Agency should specifically consider the availability of data, the clarity of instructions, and reporting format. In addition, when EPA submits this ICR for renewal, the Agency should describe its progress at further streamlining how Biennial Report site data is collected (through recommendations developed by the WIN/Informed effort); and at addressing commenters' concerns about inconsistency between the Biennial Report and the generator standards in 40 CFR 262.41 and between the Biennial Report and waste minimization information in 40 CFR 262.42(a)(6) and (7).

Abstract:
RCRA requires large quanity hazardous waste generators and treat- ment, storage, and disposal facilities (TSDFs) to submit a re- port every other year (the Bienial Report) on the quanity, com- position, and disposition of hazardous wastes they generate or receive for treatment, storage, or disposal. To implement these provisions, EPA issued the Biennial Report regulations, found in 40 CFR 262.41, 264.75, and 265.75. Generators and TSDFs must submit the Biennial Report forms by March 1 or every even number- ed year for their hazardous waste activities in the previous (odd numbered) year.
