Abstract:
This request is for revision and extension of a currently approved collection. Domestic law and international obligations require or authorize the National Marine Fisheries Service (NMFS) to collect information about the harvest of certain fishery products when these products enter United States commerce and/or are exported from the U.S. To this end, NMFS has implemented four trade monitoring programs to collect information from the seafood industry regarding the origin of certain fishery products. One of NMFS trade monitoring programs, the Seafood Import Monitoring Program (SIMP), helps determine the admissibility of imported seafood products through the collection of information from the seafood industry regarding the origin of fishery products of particular concern. NMFS collects the required information electronically through the International Trade Data System (ITDS) maintained by U.S. Customs and Border Protection. The ITDS information collection is merged with the SIMP information collection, and both were previously approved by OMB. Based on experience with SIMP implementation and additional direction from the National Security Memorandum on Combating Illegal, Unreported, and Unregulated Fishing and Associated Labor Abuses (NSM-11, 2022), NMFS is publishing a proposed rule (RIN: 0648-BK85) to expand SIMP to include additional species. In addition, the proposed rule would clarify regulatory text on importers of record and Aggregated Harvest Reports, confirm applicability of SIMP to imports into Pacific Insular Areas, and allow for chain of custody records to be made available through digital means. U.S. seafood importers are likely to be affected by this rulemaking through increased reporting and recordkeeping requirements, but the estimated magnitude of economic impact will be small because documentation is already completed, transmitted through the supply chain, and available to importers for certain products.
