Abstract:
This is a revision of a currently approved information collection Public Transportation Agency Safety Plan (PTASP) associated with a Notice of Proposed Rulemaking (NPRM). The NPRM proposes new requirements for PTASP as a result of Section 30012 of the Bipartisan Infrastructure Law (BIL), enacted as the Infrastructure Investment and Jobs Act (IIJA), Pub. L. 117-58 (Nov. 15, 2021). These new requirements carry out explicit statutory changes in the BIL and enhances Safety Management System (SMS) implementation in the transit industry. The current PTASP program has not changed, as respondents of certain operators of public transportation systems that receive federal funds under FTA's Urbanized Area Formula Grants must develop and maintain an Agency Safety Plans (ASP) that include the processes and procedures to implement SMS. All of the respondents have an existing ASP and the proposed new requirements merely need to be added to their existing plans. Since the overall program remains the same, these new requirements resulted in an increase in annual burden hours from 252,855 to 482,032. The initial burden of adhering to the proposed new requirements will be realized in Year 1, with minimal burden in Year 2 and Year 3 as outlined in the supporting statement (Table 5). Although not a result of statutory changes, there was also an increase in the respondent universe from 755 to 758, as a result of (3) new transit agencies being added to the transit industry. The new requirements as outlined in the NPRM are as follows: 1.) Each respondent that receives Federal financial assistance under 49 U.S.C. Chapter 53 must incorporate guidelines from the CDC or a State health authority regarding exposure to infectious diseases into the agency’s SMS processes. 2.) Each respondent receiving Section 5307 funds serving an urbanized area with a population of fewer than 200,000 must develop its Agency Safety Plan (ASP) in cooperation with frontline employee representatives and include or incorporate by reference in its ASP a description of how frontline transit worker representatives cooperate in the development and update of the ASP. 3.) Each respondent receiving Section 5307 funds serving an urbanized area with a population of 200,000 or more must establish a Safety Committee 4.) Each respondent receiving Section 5307 funds serving an urbanized area with a population of 200,000 or more must establish a safety risk reduction program for transit operations to improve safety by reducing the number and rates of safety events, injuries, and assaults on transit workers based on data already submitted to the National Transit Database (NTD) - Large UZA's 5.) Each respondent receiving Section 5307 funds serving an urbanized area with a population of 200,000 or more must establish safety performance targets for risk reduction programs - Large UZA's 6.) Each respondent must establish de-escalation training for certain transit workers It should be noted that in February 2022, FTA issued a Dear Colleague Letter (included in the supplementary documents section of ROCIS) outlining the proposed requirements and stated that an NPRM was forthcoming. As a result of this advance notice, a majority of the transit agencies have already updated their agency safety plans, are establishing the safety committees and many also have existing de-escalation training for their transit workers. As a result, FTA anticipates easier adherence to the proposed new requirements and the collection of information.

The change in the current supporting statement reflects a change in the burden hours from the previous PRA submittal as a result of the proposals in the NPRM and changes in the transit industry. This supporting statement reflects a small increase in the respondent universe from 755 in the previous submittal to 758 as a result of three new transit agencies under 5307 Large Bus Respondent Universe. More significantly, this supporting statement includes an increase in burden as authorized by Section 30012 of the Bipartisan Infrastructure Law, enacted as the Infrastructure Investment and Jobs Act (IIJA), Pub. L. 117-58 (Nov. 15, 2021), which amends FTA’s safety program at 49 U.S.C. § 5329(d) by adding new PTASP requirements. Under the current collection, the estimated total annual burden hours is 252,855. If the proposals in the NPRM are adopted, FTA estimated burden hours would be increased by 229,177 hours, totaling 482,032 hours and annual costs to respondents totaling $29,651,538.
